INTRODUCTION
Welcome to the Moongate platform ("Platform"), owned and operated by Moongate Inc. ("Moongate", "we", "our", or "us"). Your use of our Platform, purchase of tickets for events ("Event/s"), and registration for such events are governed by these Terms of Service ("Terms"). By using our Platform, registering for events, purchasing tickets, or otherwise interacting with our services, you signify your acceptance of these Terms. If you do not agree with these Terms, you must immediately cease using our Platform.
REGISTRATION FOR EVENTS
2.1 Registration for an Event entitles you to admittance to that Event as a Participant, subject to these Terms. Optional extras may incur additional costs.
2.2 Registration details for each Participant must be registered with us no less than two business days before the start of the Event. We reserve the right to exclude any individual not on our register of Participants.
2.3 If you register as a representative of an organization, you confirm your authority to agree to these Terms on behalf of the organization. You also ensure other Participants from your organization attending the Event are aware of and bound by these Terms.
2.4 Registration details must be accurate and complete. Any changes must be communicated to us by updating your details on our platform or contacting us using the contact information provided in any Event Confirmation.
2.5 All registrations are subject to availability and our absolute discretion.
2.6 An event pass may be required for entry to certain Events. Participants must keep their event pass on them at all times and may be required to provide evidence of their identity.
2.7 Lost, misplaced, stolen, or forgotten event passes may be replaced at our sole discretion and may incur an additional cost.
2.8 You acknowledge that photographs and filming may take place at the Event. Moongate reserves the right to use images and videos recorded at the Event with your photograph and/or likeness in future marketing materials.
2.9 Participants must be over the age of 16.
TICKETING
3.1 Collection and Use of Data: In the process of ticket purchase, we will collect certain data about you, such as your name, email address, and payment details. This data is used to facilitate your transaction, issue your Non-Fungible Token (NFT) tickets, and deliver relevant information about the Event. Our use of this data will be in accordance with our Privacy Policy.
3.2 Issuance of Tickets: Tickets for Events are issued as NFTs, which are sent to the blockchain wallet associated with your Moongate account. You bear the sole responsibility for the safety and security of your wallet and its associated private keys.
3.3 Transfer of Tickets: NFT tickets are transferable at your discretion. However, for the ticket to remain valid, the new owner must create an account on our Platform. Moongate bears no responsibility for any issues arising from the transfer of NFT tickets between individuals.
3.4 Validity of Tickets: NFT tickets are valid exclusively for the specific Event, date, and time for which they were issued. Tickets cannot be exchanged, used for other Events, or modified in any way.
ATTENDANCE REQUIREMENTS
Each Participant shall: (a) observe the rules, policies, and procedures of the Event Venue, including health and safety requirements, and any reasonable instructions issued by Moongate and/or the management of the Event Venue; (b) behave in a professional and respectful manner, not breaching laws or regulations or risking bringing the Event or Moongate into disrepute; (c) ensure they have adequate insurance for their own requirements; (d) ensure they have all necessary travel documentation. You agree that your travel to and attendance at an Event is at your own risk and not the responsibility of Moongate.
PAYMENTS
Payment for NFT tickets can be made in selected approved fiat and cryptocurrencies. Moongate does not bear any responsibility for fees or delays associated with the transaction process that are beyond our control, including, but not limited to, transaction fees required by a cryptocurrency network or currency exchange fluctuations.
REFUNDS AND CANCELLATIONS
Due to the immutable nature of NFTs, we are unable to offer refunds. All purchases are final. In the event an Event is cancelled by the organizer, Moongate will coordinate with the organizer for the possible issuance of a new NFT ticket for a rescheduled date or another event organized by the same entity. However, Moongate does not guarantee any refunds, exchanges, or compensations in such instances.
EVENT AMENDMENTS AND DISCLAIMER
Event details are subject to change by the Event organizer at any time. Moongate will strive to notify ticket holders of any changes, but cannot guarantee such notification. Moongate disclaims any liability for any direct, indirect, incidental, or consequential damages that may result from any changes to an Event, including, but not limited to, changes in date, location, or featured participants.
ADMITTANCE
Admittance to any Event is at the sole discretion of the Event organizer. The organizer reserves the right to refuse admittance to, or expel from the Event, any individual that it deems is behaving in a manner that could be disruptive to the Event or pose a threat to the safety or enjoyment of other attendees.
PHOTOGRAPHS, PUBLICITY MATERIAL, RADIO AND TELEVISION, AND PRINT MEDIA
By attending an Event, you grant permission to the Event organizer, its agents, and others working under its authority, to take and to have full and free use of video/photographs containing your image/likeness. You understand these images may be used for promotional, news, online/multimedia, research and/or educational purposes. You waive all claims to compensation or damages based on the use of your image or voice, or on the rights of privacy and publicity.
FORCE MAJEURE
We are not responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control, including but not limited to, acts of God, war, civil commotion, interruption in public communications networks or services, industrial dispute, or DDoS attacks ("Force Majeure"). Our performance under these Terms is considered to be suspended for the period that the Force Majeure Event continues.
